All Participants and Guest MUST sign the waiver below prior to entering the facility. If we do not receive a signed waiver by your session, your tee time may be canceled. Sign Below:
PROPERTY CARE AND DAMAGE
The Participant agrees to utilize the Round the Clock Golf facility, including all technical simulation equipment, golf clubs, furniture, and physical premises, with reasonable care and strictly in accordance with posted safety guidelines. The Participant acknowledges full financial responsibility for any intentional, reckless, or negligent damage caused to the equipment or premises. Deliberate damage, vandalism, or theft shall result in immediate termination of access privileges, full liability for replacement or repair costs at current market rates, and potential civil or criminal prosecution to the fullest extent of the law.
ASSUMPTION OF RISK
The Participant acknowledges and legally understands that participation in golf-related activities at Round the Clock Golf involving high-speed projectiles and swing equipment entails significant inherent risks. These risks include, but are not limited to, being struck by golf balls or clubs, slips, trips and falls on synthetic turf, technical equipment malfunction, cardiovascular overexertion, and the aggravation of pre-existing medical conditions. The Participant warrants they are in optimal physical health and assume all legal responsibility for any such physiological injury or risk, whether resulting from the active negligence of the facility or otherwise, while on the premises of this 24/7 unstaffed establishment.
RELEASE AND WAIVER OF LIABILITY
The Participant agrees to release, waive, and forever discharge Round the Clock Golf, LLC, its members, managers, employees, and agents from any and all liability, claims, or causes of action arising from the use of the facility. Furthermore, the Participant agrees to indemnify and hold harmless the released parties from any and all claims, damages, and legal expenses, including reasonable attorney fees, arising out of the Participant's actions, use of the facility, or negligence, in accordance with the laws of New York State.
ACKNOWLEDGMENT OF 24/7 UNSTAFFED FACILITY
The Participant acknowledges and understands that Round the Clock Golf operates as an unstaffed facility with 24/7 access. No personnel, including safety or medical staff, will be present on-site during operational hours. The Participant expressly assumes all risks associated with the unsupervised nature of the premises and agrees that Round the Clock Golf maintains constant video and audio surveillance for security and compliance monitoring.
INDEMNIFICATION
